These general terms and conditions of sale for accessories (hereinafter referred to as the "General Terms and Conditions of Sale for Accessories") are intended to define the conditions of sale of accessories (hereinafter referred to as "Accessory(s)") by iconicchairs.com published by Subsonic SAS (Simplified Joint Stock Company with a capital of 37,000 Euros, RCS B 509 666 178 (Lyon) accessible at the address iconicchairs.com.

Application Conditions

These general terms and conditions of sale of Products apply to any remote order placed by a natural person with legal capacity and acting on a personal basis as a consumer directly on the Site accessible at the following address: www.iconicchairs.com – access to the Site via any desktop or mobile device such as smartphones or tablets (hereinafter, together the "Site").

Exclusions from Application

The General Terms and Conditions of Sale are not applicable to professionals. A professional is considered to be any natural or legal person, public or private, who acts for purposes within the scope of their commercial, industrial, artisanal, liberal, or agricultural activity, including when acting on behalf of or for the account of another professional. Modifications to the General Terms and Conditions

These General Terms and Conditions may be modified at any time by Subsonic. It is your responsibility to consult and formally accept them before placing any order. The applicable General Terms and Conditions are those displayed on the Site at the time of your order and attached to the confirmation email of your order. Any order placed on the Site implies the full, unconditional, and unconditioned acceptance of the General Terms and Conditions in force at the time of said order.

ORDERING ON THE SITE

Any order for one or more Products (hereinafter the "Product(s)") requires you to have a valid credit card or a PayPal account and for delivery to be made to your domicile in mainland France, Corsica, and any European Union country mentioned.

Only orders for which your payments and records have been previously validated by ICONICCHAIRS.COM will be taken into account.

    When placing your order, you choose the Product(s) you wish to order. An overview of your order is presented online. You can modify it or accept it to confirm your order,
    When placing your order, you must read these "General Terms and Conditions of Product Sales," read them, and, if applicable, check the box to accept them,

The electronic data contained in the completed and validated order form by you have evidentiary value. ICONICCHAIRS.COM reserves the right, prior to the delivery of the Product(s), to carry out verifications concerning this information.

PRODUCT PRICES

The price of the Products (excluding delivery charges) is the one indicated on the corresponding product sheet, accessible on the Site. ICONIC reserves the right to modify the price of its Products at any time, in accordance with applicable legislation.

The products you order will be invoiced based on the price in effect on the Site at the time of your order validation.

The applicable price is the one indicated on the summary of your order (indicated in the confirmation email).

The price of the Product(s) is payable at the time of order and indicated in euros, all taxes included and excluding delivery charges.

For eligible products, the displayed price on the product sheet includes the amount of eco-contribution.

You can consult the amount of applicable delivery charges for your order when you select the delivery method for your order.

These potential charges are indicated to you as you proceed through the order and are billed at the end of the order in addition to the price of the selected Product(s). For professionals, any payment delay will automatically result in a late payment penalty equal to three times the legal interest rate.

Since ICONICCHAIRS.COM does not reserve stock, adding a product or service to the cart does not guarantee the availability of said Product or its price.

AVAILABILITY

Products are available as long as they are visible on the Site and unless otherwise indicated. In the event that a Product is missing, you will be contacted by ICONICCHAIRS.COM within seventy-two (72) business hours from the date of your order by email or telephone.

This contact will inform you of the expected delivery time for the Product(s).

In the event of the total unavailability of the ordered Product, you can request either a refund of the price of your entire order if it has been invoiced and collected, within a maximum period of fourteen (14) days from the payment date, or a replacement with a Product of equivalent value.

DELIVERIES

Delivery Conditions

Orders are delivered in mainland France and in the countries mentioned on the website www.iconicchairs.com, to the address of your domicile provided at the time of the order. An identity document may be requested from you at the time of delivery to verify the correspondence between your identity and the one provided at the time of your order.

In the absence of order validation, you will be informed of either the cancellation of your order or a request for additional supporting documents. In the latter case, from the receipt of these documents and their validation, your order will resume its preparation.

Subject to the availability of the receipt and validation of your files and payment methods offered by ICONICCHAIRS.COM on the day of the order, your order will be delivered no later than the date mentioned on the delivery method choice page before the final validation of your order.

For orders placed on non-working days (weekend, holidays), the deadlines are counted from the first working day following.

You have a period of forty-eight hours (48h00) after the delivery of the Product(s) to report any missing items to the customer service by email: contact@iconicchairs.com to allow ICONICCHAIRS.COM to assert its rights with the chosen carrier. You will be informed within five (5) days of the delivery time of the missing item after verification by ICONICCHAIRS.COM.

DAMAGED DELIVERED PRODUCTS

Upon receipt or collection of your order, you must check the condition of the received package(s) and report any non-conformity on the delivery note or refuse delivery.

In the event that, after accepting the package, you find that the ordered Product(s) is/are damaged, you can notify us by emailing iconicchairs.com no later than two (2) calendar days after receiving your order.

TRANSFER OF OWNERSHIP AND RISKS

The transfer of ownership of the ordered Product(s) is subject to the effective and full receipt of the price, principal, and ancillary.

Failure to pay for the ordered Product(s) may result in the reclamation of the Product(s)

 by ICONICCHAIRS.COM.

The risks (including theft, loss, damage) are transferred to you upon delivery of the Product(s), and no refund can be requested from ICONICCHAIRS.COM in this regard.

RIGHT OF WITHDRAWAL

In accordance with Article L 221-18 of the Consumer Code, you have a right of withdrawal (except in cases provided for in Article L 221-28 of the same code), which can be exercised within a period of 14 (fourteen) clear days from the day following the delivery date of your order. In the case of an order for multiple Products, the withdrawal period of fourteen days runs from the day following the receipt date of the last Product (the postmark serving as proof of the sending date). When the fourteen-day (14) day period expires on a Saturday, Sunday, or a public holiday, it is extended until the first working day following.

Withdrawal Procedure

To exercise your right of withdrawal, you can:

    Download the withdrawal form template (reproduced in Annex 2), print and complete it, and send it by email to contact@iconicchairs.com,
    write to Iconic, 314 Allée des Noisetiers, Building B, 69760 Limonest on plain paper to communicate your intention to withdraw;
    contact customer service (cf. Article VIII above).

In any case, the withdrawal document must include at least the customer's name and first name, the email given when ordering, as well as the order number and invoice.

RETURN OF PRODUCTS

You must return the product(s) subject to the withdrawal to the Seller without undue delay and, in any case, no later than fourteen (14) days following the date of communication of your decision to withdraw. This period is deemed to be met if you return the product(s) before the expiration of the fourteen (14) day period.

You can request the exchange or refund of the ordered Product(s) by email at contact@iconicchairs.com.

Return costs are borne by the customer.

The return of the products is under your responsibility and at your expense. Any damage suffered by the Product(s) on this occasion is likely to prevent the exercise of your right of withdrawal. We recommend that you take out insurance for the transportation of the returned Product(s). While these insurances remain optional, they can be useful to protect against potential breakage, loss, or theft.

The Product(s) for which a refund is requested must be returned, for security reasons, by registered mail.

The return of the Product(s) is made in their original packaging and in good condition, with all the possible accessories and documentation. The Product(s) must be in perfect resale condition. Thus, any incomplete or damaged Product resulting from manipulations other than those necessary to establish its nature, characteristics, and/or proper functioning will not be refunded.

Any order returned incomplete to the indicated address and/or in case of absence of the return number of the Product(s) and/or the return of the Product(s) to an address different from the one communicated by ICONICCHAIRS.COM will not be treated as a return and therefore not refunded.

REFUND CONDITIONS

In the event that you exercise the right of withdrawal, you will be reimbursed within fourteen (14) business days following the date on which you exercised your right of withdrawal. However, ICONICCHAIRS.COM may defer the refund until the effective recovery of the products.

It is specified that a Product benefiting from a promotional advantage will be refunded at the price you actually paid or should have paid if it no longer meets the conditions to benefit from it. In other words, the refund will be based on the price of your order invoiced and collected by ICONICCHAIRS.COM.

Only return costs are at your expense unless you have chosen to benefit from a substitute Product in case of unavailability of the Product(s).

PRODUCT WARRANTIES

All Products benefit from legal warranties and possibly a manufacturer's warranty. In this case, please refer to the user manual of your Product to know these warranties and consult the frequently asked questions on our website (Support section) www.iconicchairs.com before contacting our technical service. The latter only deals with technical defects of your electronic Product, not issues related to your order.

LEGAL WARRANTIES

If you notice a malfunction of your Product, you can contact us using the form on the website www.iconicchairs.com or by email at contact@iconicchairs.com. If the fault seems to be a warranty fault, we will proceed to exchange your Product after receiving the defective Product. For this, you will need to follow the procedure indicated by our technical service. Upon receipt of your Product, a diagnosis will be made by our advisors. If it is confirmed that the fault is covered by the aforementioned warranties, we will send you a new Product to your domicile in mainland France.

We commit to return an identical Product to you or refund the product.

If it turns out, after diagnosis, that the fault is not covered by the aforementioned warranties, we will return your original Product to you, if you confirm it during an exchange by email, the reshipment costs remaining at your expense.

In any case, you must keep the purchase receipt to be able to benefit from the warranty. It will be requested for any correspondence with our technical service.

It is recalled that within the framework of the legal warranty of conformity, the consumer:

    has a period of two years from the delivery of the goods to take action against his seller;
    can choose between repairing or replacing the goods, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code;
    is exempt from providing proof of the existence of the lack of conformity of the goods during the six months following the delivery of the goods. This period is extended to 24 months from March 18, 2016, except for second-hand goods.

The legal warranty of conformity applies regardless of any commercial warranty that may possibly cover your goods. It is reminded that the consumer can decide to implement the warranty against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code, and in this case, he can choose between canceling the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.

MANUFACTURER WARRANTIES

Manufacturer warranties do not exclude the legal warranty of conformity or the warranty for hidden defects reproduced at the end of this article.

Commercial and manufacturer warranties are valid for normal use of the Product(s) and do not cover, in particular:

    Damages whose cause is external to the Product: negligence, improper use, impact or fall, poor connection, effects of electrical surges, insufficient protection against moisture, heat or frost, lightning, water damage, modifications, repairs, or their attempts made by a person not authorized by ICONIC and more generally damages of any kind whose origin is subsequent to delivery,
    Damages suffered by the user due to a malfunction of the possible Product(s), including any loss of operation, commercial, financial, or moral damage,
    Loss, theft, or breakage of the Product(s).

DATA PROTECTION

When using our online ordering services, we will collect personal data about you.

Personal data is processed in accordance with the provisions of the Customer Personal Data Policy, available in the "Privacy Policy" at the bottom of the iconicchairs.com website.

In accordance with

 Article 34 of the "Informatique et Libertés" law of January 6, 1978, and the General Data Protection Regulation (GDPR) in effect since May 25, 2018, you have the right, during the entire storage period, to access, rectify, delete in part or in full, the personal data concerning you at any time. You can also object to the processing of your personal data, request limitation, or portability when possible. You can also send directives to ICONIC regarding the use of your data after your death. You can exercise your rights by making the request to the address: contact@iconicchairs.com. You have the right to file a complaint with the CNIL or any competent supervisory authority.

JURISDICTION

These General Terms and Conditions of Sale of Products are subject to French law. In the event of a dispute over the interpretation or performance of these terms, exclusive jurisdiction is assigned to the Commercial Court of Paris, with the exception of disputes with non-traders for which the rules of legal jurisdiction apply.
